An
Act to amend the Conciliation Courts Ordinance, 1961, in its application to the
Province of West Pakistan
Preamble.— WHEREAS it is expedient to amend the Conciliation
Courts Ordinance, 1961[2][2], in its application to the Province of West Pakistan;
It
is hereby enacted as follows:--
1. Short
title, extent and commencement.— (1) This Act may be called the Conciliation
Courts Ordinance (West Pakistan Amendment) Act, 1963.
(2) It shall extend to whole of West
Pakistan.
(3) It shall come into force at once.
2. Addition of section 12-A in Ordinance
XLIV of 1961.— In the
Conciliation Courts Ordinance, 1961, after section 12, the following new section
shall be added, namely:--
“12-A. Revision
against sentence. Any person sentenced by a Conciliation Court under
section 11 or 12 may, within thirty days from the date on which the sentence is
passed, apply in the manner prescribed for an application under sub-section (2)
of section 8—
(a) to
the Controlling Authority, if the sentence has been passed in a case relating
to a matter falling under section A of Part I or section A of Part II of the
Schedule; and
(b) to the District Judge, if
the case relates to a matter falling under section B of Part I or section B of
Part II of the Schedule;
and the Controlling Authority or the District
Judge, as the case may be, if satisfied that there has been a failure of
justice, may set aside or modify the sentence.”

This Act was
passed by the West Pakistan Assembly on 2nd July, 1963; assented to by the
Governor of West Pakistan on 11th July, 1963; and, published in the West
Pakistan Gazette (Extraordinary), dated 15th July, 1963, pages 3177-78.
