An Act to remove certain disabilities and doubts under Hindu
Law in respect of marriages between Hindus
WHEREAS it is expedient to remove certain disabilities and
doubts under the Hindu Law in respect of marriages between Hindus; It is hereby
enacted as follows:---
1. Short title and extent--- (1) This Act may be called the Hindu Marriage Disabilities
Removal Act, 1946.
[(2) It extends to the whole of Pakistan .]( Subs. by the Central
Laws (Statute Reform) Ordinance, 1960 (21 of 1960), s. 3 and 2nd Sch. (with
effect from the 14th October, 1955), for the original sub‑section (2), as
amended by A. O., 1949.)
2. Marriage between person of same gotra or pravara or of
different sub-divisions of the same caste ---
Notwithstanding any text, rule or interpretation of the Hindu Law or any custom
or usage, a marriage between Hindus, which is otherwise valid, shall not be
invalid by reason only of the fact that the parties thereto,---
(a) belong to the same gotra or pravara, or
(b) belong to different sub‑divisions of the same caste.
