NOTIFICATION
No. 1402/PBC/SEC/2005 December 31, 2005
In exercise of
powers conferred by Section 13(k) and 55(q) of the Legal Practitioners &
Bar Councils Act, 1973 and all other enabling provisions in this behalf, the
Pakistan Bar Council hereby makes and notifies the following "Pakistan Bar
Council (Recognition of Universities) Rules, 2005":
PAKISTAN BAR COUNCIL (RECOGNITION OF
UNIVERSITIES)
RULES, 2005
Chapter –1
Preliminary
1.
(i) These Rules may be called the "Pakistan Bar
Council (Recognition of Universities) Rules, 2005".
(ii) They
shall come into force at once.
2.
In these Rules unless there is anything repugnant in
the subject or context:
(a) "Act"
means the Legal Practitioners and Bar Councils Act, 1973 (Act No. XXXV of 1973).
(b) "Section"
means a Section of the Act.
(c) "Council"
means the Pakistan Bar Council.
(d) "Committee"
means Legal Education Committee of the Pakistan Bar Council.
(e) "University"
means University established by law in Pakistan and/or outside Pakistan
awarding Bachelor Degree in law.
(f)
"Degree Awarding Institution" means such
institution not designated as University but authorized to award Bachelor's
degree in Law under a statute or a charter.
(g) "Recognized
degree" means and includes a Bachelor's degree in law awarded by a
University or a Degree Awarding Institution recognized by the Pakistan Bar
Council.
(h) "Standard
of Education" includes physical factors like premises spread over about
10,000 square yards, a Law faculty of qualified and experienced teachers and
library composed of at least 20,000 volumes.
Chapter-2
Recognition of Universities and Degree
Awarding Institutions.
3.
The Universities and Degree Awarding Institutions in
Pakistan or outside Pakistan listed in First Schedule have been recognized by
the Council for the purpose of recognition of their Bachelor's Degrees in law.
4.
The Universities or Degree Awarding Institutions in
Pakistan or outside Pakistan awarding Bachelor's Degree in law which are
recognized after the framing of these Rules shall be listed in the Second
Schedule.
5.
(i) Any University or Degree Awarding Institution not
recognized by the Council may apply to the Council for recognition in the
prescribed form mentioned under Third Schedule, accompanied by a fee of Rs.
1[15,00,000/-] (Rupees Fifteen Hundred Thousand Only)]:
Provided that 2[Rs. 3,75,000/- (Rupees Three Lac and Seventy
Five Thousand only)] out of the application fee shall be non-refundable in the
event of rejection of such application.
3[(ii) Any person obtaining Bachelor's Degree in law from a
University outside Pakistan not recognized by the Council may apply for the
recognition of said University and its law degree on the prescribed form
mentioned in the Fourth Schedule with a nonrefundable fee of 2{Rs. 25,000/-}.]
6.
The Committee on receipt of such application shall hold
inquiry into the standard and quality of education being imparted by applying
University/Institution:
Provided
that such application shall be decided within reasonable period of time not
exceeding six months.
4[“6-A. The applicant University/Degree Awarding
Institution shall have to submit an undertaking in writing on a stamp Paper of
Rs. 50/-, to he effect that it shall:-
(i)
not affiliate any private law college at any place, nor
itself will conduct law classes any where else except of it s main campus;
(ii)
not admit more than 50 law students in an academic
year;
(iii)
abide by and adhere to the minimum standards as laid
down in the Rules of Affiliation of private law colleges prescribed/recommended
by the Pakistan Bar Council and its instructions/directions & the Rules
issued and framed from time to time in respect of legal education, the
violation of which will render it to be derecognized;
(iv)
ensure imparting of quality education strictly in
accordance with the syllabus prescribed by the Higher Education Commission and
the Pakistan Bar Council; and
(v)
ensure conducting and adhering only to 5 years
composite programme of LL.B.
as per standards and criteria prescribed by the Higher
Education Commission.”]

Inspection and
Derecognition
7.
(i) If the Committee at any time after inspection is
satisfied that a University and a Degree Awarding Institution in Pakistan
recognized by the Council is imparting substandard education, it may, after due
enquiry, recommend derecognition of such University or Degree Awarding
Institution to the Council.
(ii)
The Council after receipt of such recommendation and
after giving opportunity of hearing may derecognize such University or Degree
Awarding Institution and order deletion of its name from the First or Second
Schedule as the case may be.
(iii)
The Council or the Committee may, as the case may be,
associate any member of a Provincial Bar Council during the course of any
inspection or inquiry.
8.
Any University or Degree Awarding Institution aggrieved
by the order of derecognition, may file a review petition within 30 days of the
receipt of the order of derecognition before the Council accompanied by a fee
of Rs. 50,000/- (Rupees Fifty Thousand only).

No LL.B or LL.M Degree shall be considered and accepted by a Bar Council as
qualification for enrolment as an Advocate unless it has been obtained from a
University/Degree Awarding Institution recognized by the Pakistan Bar Council
under relevant provisions of the Legal Practitioners & Bar Councils Act,
1973.

(a) The Universities/Degree Awarding Institutions in Pakistan stand
recognized and listed in First Schedule, shall certify and inform the Pakistan
Bar Council in writing at the start of every academic year, to the effect that
each and every private law college affiliated with it, is implementing in
letter and spirit, the “Affiliation of Law Colleges Rules” of the Pakistan Bar
Council and is imparting legal Education strictly in accordance with the
Syllabus prescribed by the Higher Education Commission and the Pakistan Bar
Council.
(b) It shall be the duty of the
University/Degree Awarding Institution to de-affiliate a private law college
found delinquent in implementing the Affiliation of Private Law Colleges Rules
of the Pakistan Bar Council.
11. A University/Degree Awarding
Institution in case of imparting legal education at the level of LL.M. shall
have to get approved the syllabus of its LL.M. classes and the list of Faculty
Members engaged by it for that purpose from the Higher Education Commission and
the Pakistan Bar Council.]

Application
for recognition of a University or Degree Awarding Institution imparting legal education.

Dear Sir,
We hereby apply for recognition of _____________________________________________

(Name of University/Degree Awarding Institution)
in terms of Sections 13(k), 26 and 55(q) of the Legal
Practitioners & Bar Councils Act, 1973. The has been lawfully (Name of University/Degree Awarding Institution)
established under Charter of the
Government of ____________ as published in the official Gazette, a copy of
which is enclosed.
The aforenamed University/Institution do hereby declare that
it--
(i) is
authorized and competent to impart legal education and award law degree;
(ii) shall
act and function within its territorrial limits;
(iii) shall
introduce the syllabus of minimum 3 years LL.B courses which will essentially
include the syllabus/courses prescribed by the Pakistan Bar Council and the
Higher Education Commission and comply with changes/amendments brought about by
them from time to time. The syllabus of 3 years LL.B course the
University/Institution intend to introduce is enclosed;
(iv) shall
restrict imparting of legal education to its Law Faculty/Department only and
will not affiliate any private law college;
(v) shall
ensure strict compliance of provisions of the Pakistan Bar Council Legal
Education Rules, 1998, the Pakistan Bar Council (Recognition of Universities)
Rules, 2005 and the conditions prescribed under the Affiliation of Law Colleges
Rules prepared by the Pakistan Bar Council;
(vi) shall
make every effort to ensure imparting of standard and quality legal education;
(vii) has
established a full fledged Faculty of Law and engaged/employed highly qualified
(in conformity of the standards prescribed in various Rules of the Pakistan Bar
Council pertaining to legal education) members of the faculty and other
teaching staff;
(viii) shall impart
legal education only in morning classes;
(ix)
has deposited the requisite fee of Rs. 15,00,000
(Rupees Fifteen Hundred Thousand Only)]: in the account of the Pakistan Bar
Council. (The fee may either be deposited in Account No. 82-37 of the Pakistan
Bar Council with Habib Bank Limited, Supreme Court
Branch, Islamabad or remitted
through Pay Order/Demand Draft in the name of the Pakistan Bar Council);
(x) will
be liable to be de-recognized in case of its failure to comply with any of the
provisions of Rules of the Pakistan Bar Council and its instructions issued
from time to time.

profession and get myself enrolled as an Advocate on the basis of my Law
Degree.
Since the
_________________________________________ is not among those recognized
(Name of University)
by the Pakistan Bar Council, I
hereby request that it may please be recognized in terms of Sections 13(k), 26
and 55(q) of the Legal Practitioners & Bar Councils Act, 1973. Copies of
relevant documents regarding status of the University and detail of its law
courses, etc are enclosed for perusal.
The requisite fee of Rs. 25,000-
(Rupees Twenty five Thousand only) has since been deposited in account of the
Pakistan Bar Council.
I undertake to furnish any
additional information/documents required by the Legal Education Committee of
the Pakistan Bar Council at any subsequent stage.
