TOBACCO, (PURCHASE BY MANUFACTURERS) RULES, 1972,

R. O. 662(1)/72.-In exercise of the' powers conferred by section 30 .of the
Pakistan Tobacco Board Ordinance, 1968 (1 of 1968), the Central Government is
pleased to make the following rules, namely;.-
1. Short title and
commencement.--(1) These rules may be called the Tobacco (Purchase by
Manufacturer) Rules, 1972.
(2) They shall come into
force at once.
2. Definitions.-In these
rules, unless there is anything repugnant in the subject or context,-
(a) "Centrally
Administered Areas" has the same meaning as in the Province of West
Pakistan (Dissolution) Order,-1970.(P. O. No. 1 of 1970); 1.
(b)
"Ordinance" means the Pakistan Tobacco Board Ordinance, 1968 (I of
1968) ; and
(c) "Tobacco
Season" means the year commencing on the first day of July and ending on
the thirtieth day of June.
3. Order under section
20J-A of Ordinance when to be made.-----An order under section 20-A of the Ordinance
may be made by the Central Government if ft is satisfied that, due to abnormal
circumstances, there is a likelihood of such excessive fluctuation in the
production of tobacco in any tobacco season ,as compared to Its production in
the immediately preceding season as may have an adverse effect on the interests
of the growers of tobacco.
4. Determination of
total quantity to be purchased,.-Where the Central Government intends to make
an order under section 20-A of the Ordinance, ft shall first determine the
total quantity of tobacco to be purchased, by the manufacturers during a
specified tobacco season, having due regard to the need to avoid excessive
fluctuation in the output of tobacco, from year to year, as well as the
desirability of maintaining a balance, in the long-run, between the supply and
demand of tobacco.
5. Allocation to each
manufacturer.-The total quantity as determined under rule 4 shall be allocated
among the manufacturers pro rata on the basis of the aggregate of the quantity
of cigarettes sold by each manufacturer in the Provinces of Baluchistan. the
North-West Frontier, the Punjab, and Sind and the Centrally Administered Areas
during the twelve months period ending the 30th June immediately preceding the
date of orders and the quantity of tobacco actually exported by the
manufacturer in the same period.
6. Following the
allocation made under rule 5 the Central Government may direct a manufacturer
to take such steps as may be necessary to ensure the purchase of the requisite
quantity of tobacco, at the appropriate time.
