PUNJAB SUPPLY AND SALE OF HEMP DRUGS RULES

THE PUNJAB SUPPLY AND SALE OF HEMP DRUGS RULES
NOTIFICATION
[8th March 1932]
The Punjab supply and sale of Hemp Drugs Rules were published in Financial Commissioner’s Notification No.1352-E&S, dated the 08.03.1932.

18.1. There shall be the following four kinds of licenses for vend of hemp drugs:                             (a)      Not reproduced being unnecessary.
(b) Licenses for the wholesale vend at a shop of and bhang not in bond. Such licenses are hereinafter called wholesale (general licenses) and shall be in Form H-26.
(C)       Licenses for the retail vend at a shop of: -
(1)------------------------------------------------------------.
(2) Bhang or any preparation or admixture thereof
Such licenses are hereinafter called retail licenses and shall be in Form H-28.
18.2. The fees payable for a wholesale license for the whole or any part of the financial year shall be as follows: -
(a)------------------------------------  Rs.
(b) Whole sale (general) license.   Rs.16/-
The fee payable for retail licenses shall be fixed by auction or tender.
Wholesale and retail licenses shall be granted by the Collector. For wholesale (in bond) and wholesale (general), licenses, payments shall be made in advance of the prescribed fee. Retail Licenses shall be granted in conformity with rules 18.08 and 18.9.
No license for the vend of intoxicating hemp drugs shall, without the previous sanction of the Excise Commissioner be granted for a period extending beyond the term of the Financial Year in which the license is granted.
No license is transferable but the collector may permit a licensee to add any person or partner in his business or to transfer his license to any person.
All the rules prescribed in the Punjab Liquor License Rules notified under Financial Commissioner No.5556-E&S, dated the 21.11.1932, for the grant by auction or tender of liquor licenses shall as far as applicable apply to the grant by auction of tender of hemp drugs licenses.
The Collector shall dispose of retail licenses, by auction or tender, either separately or in groups, as he may decide, subject to the concurrence of the Excise Commissioner which is to be obtained through the Commissioner of the division.
The monopoly of the right of retailing a vend in a district or specified part of a district may be farmed under an agreement in form H.29, with the sanction of, and subject to conditions approved by the Excise Commissioner.
If any person who has held a license under these rules, shall have in his possession on the expiry or determination from any other cause, such as cancellation, etc, of his license, any Hemp drugs, which he was unable to dispose of during the time when his license was current under the provisions of these rules, to any person licensed or authorized to purchase it, he shall dispose it of in such manner as the Collector may direct.
Any person who is granted a retail license shall be bound, if so desired by the Collector of the district in which he holds his license, to take over the surplus stock of the person who held the retail license, for the same place in the proceeding year, at a price to be fixed y the Collector.
The licenses shown in this rule are granted subject to the special conditions noted under each, in addition to the conditions laid down in these rules.
(1)             Not reproduced being unnecessary-------.
(2)             A license in Form H-26 for the wholesale vend has --------------- and bhang, not in bond:
(a)             (i) The licensee shall not, under this license, sell bhang other than that on which duty has been paid of such kind and at such rate as the Provincial Government may impose in exercise of the Powers conferred on it by sections 31 and 32 of the Excise Act, 1914.
(ii) The licensee shall, in respect of any drugs, which he is licensed to sell meet the demand of every customer entitled to be served, who tenders payment for what is required by him, and the licensee shall maintain a sufficient stock of drugs of good quality in which he is licensed to deal, to meet the probable demand.
(b)             The licensee shall not sell under this license at one time to one-person bhang in less quantity than five seers.
(c)              He shall not keep in stock, or sell, either mixed with the hemp drugs which he is authorized to sell or separately any Chloral hydrate, butrychloral hydrate, or para-aldehyde.
(d)             The licensee shall not held directly or indirectly through any agent any license in a Pakistani State for the vend of spirit, fermented liquor or any intoxicating drug as defined in the Excise Act for the time being in force in the Punjab, or of opium, as defined in the Opium Act for the time being in force in the Punjab, nor shall be act as the agent of any person holding such a license.
(e)             The licensee shall not allow any person to conduct sales on his behalf unless the name of such person has been previously submitted to the Collector for approval and endorsed by him on the license.
(f)              (i)         The licensee shall maintain daily accounts of sales made by him under this license and of his balances to store in the following form: -
