BALOCHISTAN SPORTS BOARD ACT 2009
ACT NO. XI OF 2009
AN
ACT
to
provide for the establishment of a Sports Board in the Province
of Balochistan and the matters ancillary thereto
WHEREAS it is expedient to establish a
Sports Board in the Balochistan;
It
is hereby enacted as follows:-
1. Short title, extent and commencement.---(1) This Act may be called the
Balochistan Sports Board Act 2009.
(2). It
shall extend to whole of the Balochistan.
(3). It
shall come into force at once.
2. Definitions.---In
this Act, unless, there is anything repugnant in the subject or context:-
a. “Act”
means the Balochistan Sports Board Act 2009;
b. “Association” means an association of any
sports or game duly registered with the Board;
c. “Board” means the Board constituted
under section 4 of this Act;
d. “Bye
laws” means the bye-laws of any Association;
e. “Chairman”
means the Chairman of the Board;
f. “District and City Sports Committee”
means a District and City Sports committee constituted under section 15 of this
Act established under section 13;
g. “Club” means a club organized to promote
sports/games and duly registered with a Tehsil Committee, a District Committee
or as the case may be a City Committee;
h. “Executive Committee” means the Executive
Committee constituted under section 9 of this Act;
i. “Fund” means the fund of the
District or City Sports Committee or, as the case may be, the Board established
under this Act;
j. “Government” means the Government of
the Balochistan;
k. “member” means a member of the Board, the
Executive Committee, the District City Sports Committee or, as the case may be
Tehsil Sports Committee.
l. “prescribed” means prescribed by
rules or regulations made under this Act;
m. “Presiding Officer” means the
Presiding Officer of the Executive Committee, the District or City Sports
Committee or as the case may be the Tehsil Sports Committee;
n. “Province” means the Balochistan Province ;
o. “regulation” means regulation made
under this Act;
p. “rules” means the rules made under
this Act;
q. “Secretary” means the ex officio
Secretary of the Board;
r. “Subordinate Offices” means
divisional, District and Tehsil Sports Committees in the Balochistan Province
and such other organizations and stadia, the Ayub Stadium, Gen. Musa Hockey
Stadium, International Tartan Track, International Swimming Pool, Taji Khan
Sports, Complex, Firing Range, Football Stadium, Dalbandin, Football Stadium
Pishin and such other sports centers as are under the administrative control or
purview of the Board;
s. “Tehsil Committee” means a Sports Committee
for a Tehsil;
3. The Board.--- (1) As soon as may be after the commencement of this
Act, there shall be established a Board to be known as the Balochistan Sports
Board.
(2). The Board shall be a body corporate having
perpetual succession and a common seal , with powers, subject to this Act, to
acquire and hold properly, both movable and immovable, and may by the said name
sue and be sued.
(3). The headquarter of
the Board shall be at Quetta and the Directorate of Sports Balochistan shall
provide secretariat facilities to the Board.
4. Composition of the Board.--- (1) The Governor of the
Balochistan shall be the Patron-in-Chief of the Board.
(3)
The
Board may, with the prior approval of the government, co-pt such other members
on the Board as it considers necessary for the advancement of sports in the
Province.
(4)
The
tenure of a non-official member shall be two years.
(5)
If
the seat of a non-official member becomes vacant during the term of his office,
the vacancy shall be filled in the same manner in which the person whose place
is being filled was appointed. The person so appointed shall hold office for
the residue of such term.
5. Removal of a member.--- The Executive Committee may by order in writing, remove
a non- official member, if he.
a. refuses or fails to discharge or
becomes incapable of discharging his duties under this Act or
b. has, in the opinion of the Board
abused his position as member; or
c. has, without reasonable cause,
absented himself from three consecutive meetings of the Board; or
d. has been convicted of an offence
involving moral turpitude.
6. Powers and Functions of the Board--- The powers and functions of the
Board:-
(a) to register sports associations, hold their
elections under the supervision of the Board or the District Sports Committees
or the City Sports Committees or as the case may be the Tehsil Sports
Committees;
b. to provide extension services to the
in-service personnel in the form of refresher courses, training and coaching
programmes, seminars, conferences and workshops, etc;
c. to evolve policies for the promotion
and development of various sports and games in the Province;
d. to ensure establishment of sports
complexes at Provincial/District/City/Tehsil Headquarters; permanent training
and coaching centers sports hostels etc, in the Province;
e. to exercise administrative and
functional control over all the stadia and play fields in the province, and to
ensure their proper maintenance and utilization;
f. to ensure, adequate provision, of
play fields, allied facilities and equipment in the Province;
g. to ensure adequate provision of
funds for sports and games in the budget of Local Government and other
institutions and their utilization to the fullest advantage for promotion and
development of sports;
h. to provide incentive to prominent
sportsmen, promising/deserving players and organizers/employees by granting
rewards/scholarships/honoraria, etc;
i. to arrange production of films and
publication of literature and establish reading facilities for the promotion
and development of sports;
j. to encourage and promote formation
of clubs at district level;
k. to maintain liaison with all
Central/Provincial Government Semi Government, Departments/Agencies for effective
implementation of the policies regarding promotion and development of sports
and games;
l. to keep liaison with all
Commissioners/Nazims/District Coordination Officers in the Province to ensure
effective functioning of Sports Committee and Associations for the projection
of policies of the Government and the Board;
m. to approve the annual budget of
grants-in-aid to registered Association clubs and other sports organizations in
the Province;
n. to ensure that grants given are
utilized for the purpose and in accordance with the objects for which these are
given;
o. to arrange training and coaching
programmes;
p. to ensure mass participation in
sports and games by organizing sports competitions/tournaments in the Province of International , National, Provincial and District
level;
q. to organize annual youth
competitions of various age groups in different games;
r. to do generally all such acts and
take all such steps as it considers necessary and conducive to achieving its
aims and objects toward promoting sports activities in the Province;
s. to take such disciplinary action as
may be necessary against any Association in the Province, its office bearers or
members or sportsmen in the interest of the sports and in order to maintain
discipline;
t. to withhold grant-in-aid to such
associations, clubs and other sports organizations as are funded to be
disregarding or violating the provision of this Act the rules or regulations
made their under or who fail to carry out the direction issued by the Board
from time to time;
u. to acquire and dispose of property
and generally to enter into contracts;
v. to appoint and determine the terms
and conditions of service of officers and other servants of the Board;
w. to associate and engage any person
whose assistance or advice is considered necessary for the promotion or
development of sports and to prescribe terms and conditions thereof, and
x. to frame, subject to the approval of
Government, regulation for carrying out the purposes of this Act.
7. Meeting of the Board.--- (1) A general
meeting of the Board may be held as and when required but it shall be held at
least once a year. A special meeting may be held to transact any special
business of the Board, when summoned by the Chairman or the Executive
Committee, provided that in the absence of the Chairman, the vice-Chairman may
summon a special meeting.
(2). A general or
special meeting shall be presided over by the Chairman, or in his absence, by
the Vice-Chairman.
(3). One-third of
the members of the Board shall constitute a quorum for meeting of the Board, a
fraction being counted as one.
(4). All decisions
in a meeting of the Board shall be taken by majority of votes. In case of
equality of votes, the Chairman or as the case may be, the Vice-Chairman, shall
have a casting vote.
8. Executive Committee.--- (1). Government
may, by a notification in the Official Gazette, constitute an Executive
Committee of the Board, consisting of-
(a) The Secretary Sports Department
Government of Balochistan Chairman
(b) A representative of Finance
Department, Government of Balochistan Member
(c) A representative from Women Sports
Association Member
(d) The Director Sports Balochistan Member
(2). Three
members of the Executive Committee, including the Presiding Officer shall
constitute a quorum for a meeting.
(3). The
Chairman shall call meetings of the Executive Committee, as and when required
and shall preside over the meeting.
(4). All the
decisions of the Executive Committee shall be taken by majority of votes, in
case of equality of votes, the Chairman shall have a casting vote.
9. Power of the Executive Committee.--- (1). The Executive Committee shall be competent to deal with any
matter within the competence of the Board, including the following:
a. to recommend the
affiliation/registration of the games and associations to the board;
b. to ensure that the managing body of
each of the Provincial games and sports associations functions in the best
interest of that games and in conformity with its constitution and bye-laws;
and
c. to allocate funds, grants in-aid and
subsidies to the games and Associations registered with the Board, to sportsmen
and to sanction expenditure for sports activities, schemes or sports events of
special nature.
(2). After
approval of the budget by the Board, the Executive Committee shall be competent
to re-appropriate a budgetary allocation.
10. Functions, powers and duties of the
Secretary of the Board.---
(1) The Director Sports Balochistan Province shall be ex officio Secretary of
the Board.
He shall be provided the permanent
Secretariat for Board.
(2) The
Director Sports in his capacity as Secretary of the Board, shall-
a. sanction all expenditure as provided
in the budget of the Board;
b. have powers to make appointment of
coaches and other staff subject to such conditions as may be prescribed;
c. have powers to check and inspect
accounts and general working of the games and Associations and the District City and Tehsil Committees;
d. submit the annual report and the
audited accounts together with balance sheet to the Board for approval; and
e. perform such other functions as may
be assigned to him by the Board, the Executive Committee or the Chairman.
11. Divisional
Sports Committee. ---
There shall be in every Divisional Sports Committee which shall consist of :-

to five non officials to be nominated by the commissioner/ Chairman with at least one from
each district

One
representative each of four sports organizations of the Division to be
appointed by the Chairman on rotation for a term of two years.

|
|
Two
headmaster ( 1 male and 1 female).

12. Power and Functions. --- (1)The committee shall have the
powers to :-
(i)
register
the divisional Sports organizations subject to such terms and condition as may
be prescribed;
(ii)
to
make grants-in-aid to such sports organizations as are registered with the
Divisional Committee and the District Committee in the Division;
(iii)
take
such disciplinary action as may be necessary against any sport organizations of
the Division, its office bearers, or members as it deems fit in the interest of
the games and in order to maintain discipline;
(iv)
collect
sports share in the income of the Local Councils in accordance with policy
instructions of the Government; and
(v)
see
and ensure that the funds of the Division Sports Committee and its subordinate
organization and District and Tehsil level are utilized exclusively for
organization and promotion of sports and for no other purpose.
(2) The fund of
Divisional Sports Committee shall include :-
(a) annual Grants-in-aid from the Board.
(b) special grant-in-aid from the Board.
(c) donations, etc; and
(d) income from tournaments, matches,
camps, stadia and other properties.
(3) The Chairman, Divisional Sports Committee
shall have the power to incur expenditure on Sports in the Division in line
with the policy and objectives laid down by the Board subject to such limits as
may be prescribed.
(4) The accounts of the Divisional Sports
Committee shall be got audited in such a manner as may be prescribed.
(5) A meeting of the Divisional Sports
Committee shall be held not less than once in six months. The Chairman shall, however, be
competent to call additional meetings of the Committee.
(6) For the meeting of the Committee, at
least 1/3rd of the total membership shall form the quorum.
13. District
and City Sports and Committee.--- There shall be in every District a
District Sports Committee and in every City a City Sports Committee, which shall
consist of –
(a) The
District Coordination Officer of the District concerned. Presiding Officer
(b) The
Executive District Education Officer of the District concerned. Member
(c) Two
philanthropists to be nominated by Member
the Chairman for a period of two
years.
(d) Two
lady members to represent women sports to be Member
nominated by the Chairman for a
period of two years.
(e) Two
leading sportsmen of the District concerned. Member
(f) Two
Public representatives. Member
(g) The
District Sports Officer of the District concerned. Member
14. Power
and functions.--- The Committee constituted under section 13 shall have
the powers to-
(a)
register
the District or, as the case may be the City Sports Associations, subject to such
terms and conditions as may be prescribed;
(b) make grants-in-aid subject to
availability of funds, to such sports organizations as are registered, with the
District or City Committee and Tehsil Committee in a District or City;
(c)
take
such disciplinary action as may be necessary against any sports organization of
the District or City, its office bearers or members, as it deems fit in the
interest of the games and in order to maintain discipline;
(d) collect sports share in the income
of the Local Government in accordance with policies and instructions of the
Government;
(e)
have
a watch and ensure that the funds of the District or, as the case may be. The
City Sports Committee and its subordinate organizations at District
City and Tehsil level, are utilized exclusively for the
organization and promotion of sports and for no other purpose; and
(f)
organize
sports competitions and training camps in different games for various age
groups.
15. Fund.--- The fund of District or
City Sports Committee shall include:-
(a)
annual
grants-in-aid from the Board;
(b) special grants-in-aid from the
Board;
(c)
donations;
(d) income from tournaments, matches
camps stadium, other properties; and
(e)
contribution
from Local Government.
16. Powers
of the Presiding Officer to incur expenditure.--- The President of the
District or City Sports Committee, as the case may be, shall have the power to
incur expenditure on sports in the District or City in line with the policies
and objectives laid down by the Board subject to such limits as may be
prescribed.
17. Audit
of accounts of District or City Sports Committee. --- The accounts of
the District or City Sports Committee shall be got audited in such manner as
may be prescribed.
18. Meeting
of District or City Committee. ---- A meeting of the District or City
Committee, as the case may be, shall be held at least once in a year. The
Chairman shall be competent to call additional meetings of the Committee, when
so needed.
19. Quorum
of meeting of District or City Sports Committee. ---For the meeting of
a District or City Sports Committee at least one- third of the total membership
shall form quorum.
20. Tehsil
Sports Committee, --- (1) There shall be a Tehsil Sports Committee in
each Tehsil.
(2) A Tehsil
Sports Committee shall consist of:-
(a)
The
Tehsil Municipal Officer (TMOs). Presiding Officer
(b)
Two
elected members of the Tehsil Council to be Member
nominated
by the Committee.
(c)
The
Assistant District Education Officer (Male). Member
(d)
The
Assistant District Education Officer (Female). Member
(e)
Two
philanthropists to be nominated. Member
by the Presiding Officer for a
period of two years.
(f)
Two
female members to represent women. Member
to
be nominated by the Tehsil
Sports Committee.
(g)
The
Tehsil Sports organizer Member
Cum-Secretary
21. Powers
and functions.(1) The Tehsil Sports Committee shall have the powers to-
(a) Register Tehsil Sports Organizations and
Clubs on such terms and conditions as may be prescribed;
(b) Make grants-in-aid to such sports
organizations as are registered with it or deserving sportsmen and sports
women;
(c)
take
such disciplinary action as may be necessary against any Tehsil Sports
Organization/Club in the Tehsil, its office bearers or individuals in the
interest of the game and in order to maintain discipline; and
(d)
to
organize sports competitions/training camps in different games of various age
groups;
(2) The
grants sanctioned by the Presiding Officer and expenditure incurred by him
shall be placed before the Tehsil Sports Committee in its next meeting for
approval;
(3) The
accounts of the Tehsil Sports Committee shall be audited in such manner as may
be prescribed.
(4) The
Presiding Officer, shall have the powers to sanction funds and incur
expenditure for organization and promotion of sports in the Tehsil subject to
such limits as may be prescribed;
(5) The
Tehsil Sports Committee shall collect its share in the income of the Local
Government in accordance with policy instructions of Government;
(6) The Fund of Tehsil Sports Committee shall
include-
(a)
annual
grants-in-aid from the Board, including special grants, if any;
(b)
donations;
and
(c)
income
from tournaments, matches, camps, stadia, Local Governments and its properties;
(7) The
Tehsil Sports Committee shall meet at least once in a year for a meeting one third
of the members of the Tehsil Sports Committee shall form the quorum. The
Presiding Officer may call additional meetings of the Tehsil Sports Committee
as and when needed;
22. Registration.
---- The Association shall be registered with the Board subject to such terms
and conditions as may be prescribed by rules and regulations.
Provided that any other sports organization in the Province
may be registered with the Board subject to such conditions as the Board may by
rules and regulations prescribe.
23. Registration
of District/City Sports Organizations. --- The District or City Sports
Organizations shall be registered with the District/City Sports Committees
subject to such terms and conditions as may be prescribed by rules and
regulations.
24. Registration
of Tehsil Sports Organization.---The Tehsil Sports Organizations and
Clubs shall, if any, be registered with the Tehsil Sports Committee as may be
prescribed by rules and regulations.
25. Penalties.---Where
an Association, Club or any other sports organization is found to have violated
its constitution or bye-laws or the rules and regulation made under this Act,
the registering authority shall cancel the registration of such Association,
Club or any other sports organization; provided that no such order of
cancellation shall be made without giving an opportunity of being heard.
26. Funds,
accounts and audit.---(1) There shall be a fund known as the
Balochistan Province Sports Board Fund, hereinafter referred to as ‘the Fund’.
(2) The
Fund shall consists of-
(a)
the
grants made by Government;
(b)
donations
made by any person, institution or organization;
(c)
income
accruing from any property of the Board or its investment;
(d)
loans
raised or obtained by the Board with the prior approval of Government; and
(e)
all
other sums received by the Board;
(3) The
Fund shall be utilized exclusively for the promotion and development of sports
and games in the Province and for matters ancillary or incidental thereto.
(4) The
Fund shall be maintained in such manner as may be prescribed.
(5) The
accounts of the Board shall be audited once in every financial year by the
Auditor General of Pakistan .
(6) The
audit report shall be submitted to the Board and with comments of the Board to
Government. The Board shall comply with and direction issued by Government for
rectification of an audit objection.
27. Budget
and expenditure.---(1) Secretary of the Board shall prepare the annual
budget for the utilization of the funds to be approved by the Board in its
meeting.
(2) The
Board shall have full powers to incur expenditure.
(3) The Executive
Committee shall have full powers to incur expenditure within the approved
budget.
(4) The Chairman
of the Board shall have such powers to sanction and incur expenditure as the
Board may delegate to him with the prior approval of Government.
(5) The sanction
of various grants-in-aid accorded by the Chairman shall be placed before the
Board in its next meeting for approval.
(6) The Secretary
of the Board shall have full powers to incur expenditure on the items approved
in the budget of the Board.
(7) The accounts
of the Board shall be operated by the Secretary of the Board.
28. General
Provisions. --- Government may give such directions to the Board or
require it to furnish such documents, returns, statements or any other
information regarding any matter under the control of the Board and the Board
shall comply with all such directions or requisitions.
29. Conferring
of powers and functions.--- The Chairman and the Secretaries of the
Board, District, City and Tehsil Committee shall exercise such powers and
perform such functions as may be prescribed by rules and regulations.
30. Power
to make rules.---(1) Government may make rules to carry out the purpose
of this Act.
(2) The Board may, with the approval of
Government, make regulation, not inconsistent with rules, to carry out the
purposes of this Act.
