THE GOMAL UNIVERSITY (AMENDMENT) ORDINANCE. 1981.
N.-W.F.P. ORDINANCE NO. VIII OF 1981. 16th JULY, 1981.
AN
ORDINANCE
further to amend the Gomal University Act, 1974.

WHEREAS it is expedient further to amend the Gomal University Act, 1974 (N.-W.F.P. Act X of 1974), in the manner hereinafter appearing;
Preamble
AND WHEREAS the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of the fifth day of July, 1977, read with the Laws (Continuance in Force) Order, 1977 (C. M.L. A. Order No. 1 of 1977), and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province is pleased to make and promulgate the following Ordinance:


1.         (1) This Ordinance may be called the Gomal University (Amendment) Ordinance, 1981.
Short title and commencement
(2) It shall come into force at once.

2.         In the Gomal University Act, 1974 (N.-W.F.P. Act X of 1974), hereinafter referred to as the said Act, in section 10, sub-section (7) shall be omitted.

3.         In the said Act, in section 21,—
(i)      in sub-section (1),—
(a)     in clause (ii), after the word "Assembly ", the words "to be" shall be inserted:

 (b)    in clause (iii), the words and comma "other than the employees of the University or affiliated colleges," shall be omitted:
(c)     for clause (viii). the following clause shall be substituted, namely:
"(viii) one Professor and one Associate Professor of the University to be elected by the Professors and Associate Professors of the University, as the case may be, from amongst them-selves;".
(d)    for clause (ix), the following clause shall be substituted, namely:
"(ix)  one Assistant Professor and one Lecturer of the University to be elected by the Assistant Professors and Lecturers of the University, as the case may be, from amongst themselves :
Provided that a Lecturer shall be eligible for election if he has completed a minimum of two years service in the University;";
(e)     in clause (xi), the word "and" at the end shall be omitted;
(f)     in clause (xii), for the fullstop at the end a semicolon shall be substituted; and
(g)     after clause (xii) amended as aforesaid, the following new clauses shall be added, namely:
(xiii)  one Aalim to be nominated by the Chancellor; and
(xiv)  one woman to be nominated by the Chancellor."; and
(ii)     in sub-section (2), for the word "two ", the word "three" shall be substituted.

Insertion of new 41 A to N.W.F.P Act X of 1974.
4.         In the said Act, after section 41, the following new section shall be inserted, namely:
"41 A. Member of an Authority to cease to be member in certain circumstances.—An elected, appointed or nominated member of any Authority shall cease to be a member if he—
  1. absents himself, without the leave of such Authority, from three consecutive meetings thereof; or
  2. accepts any assignment which involves his absence from the University for a period of six months or more.".
Insertion of new section 48 A to N.W.F.P Act X of 1974.
5.         In the said Act, after section 48, the following new section shall be inserted, namely:
"48A. Tripartite mobility—(1) Any officer, teacher or other employee of the University shall, as the Chancellor may direct, serve in a Government department or an educational or research institution in the public interest:
Provided that the terms and conditions offered to him shall not be less favourable than those admissible to him in the University and that full benefit of his previous service shall be allowed to him:
Provided further that, in the case of a teacher, such direction shall be issued after consulting the Syndicate.
(2) The Chancellor may place the services of an employee of Government or any other University or an educational or research institution at the disposal of the University in the public interest:

Provided that the terms and conditions offered to him shall not be less favourable than those enjoyed by him immediately before his services are placed at the disposal of the University and that full benefit of his previous service shall be allowed to him:
Provided further that, in the case of a teacher, the Chancellor may consult the Selection Board of the University before placing his services at the disposal of the University,"

6.         In the said Act, in the Schedule,—
(a)     in statute 2, for clause (2) the following clause shall be substituted, namely:
"(2) The Dean of each Faculty shall be appointed by the Chancellor from amongst the three most senior Professors in the Faculty."; and

 (b)    in statute 3, for clause (2) the following clause shall be substituted, namely:
"(2) The Chairman of a Teaching Department or the Director of an Institute shall be appointed by the Syndicate on the recommendation of the Vice-Chancellor from amongst the three most senior Professors and Associate Professors of the Department for a period of three years:
Provided that in Departments in which there is no Professor or Associate Professors, the Department shall be looked after by the Dean of the Faculty with the help and assistance of the most senior teacher of the Department.".
