SARDAR BAHADUR KHAN WOMEN’S UNIVERSITY (AMENDMENT) ACT 2014 (ACT NO. VIII OF 2014)

(Amendment) Bill 2014, (Bill No.09 of 2014), having been passed by the Provincial Assembly of Balochistan on 1st February, 2014 and assented to by the Governor, Balochistan on 11th  February, 2014 is hereby published as an Act of the Balochistan  Provincial Assembly.
THE SARDAR BAHADUR KHAN WOMEN’S UNIVERSITY (AMENDMENT)
                  ACT 2014 (ACT NO. VIII OF 2014)
 (First published after having received the assent of the Governor Balochistan in the Balochistan Gazette (Extra-ordinary) dated 11th February 2014).

to amend the Sardar Bahadur Khan Women’s University Quetta Act 2004 (Act No. IX of 2004).

                                     
Preamble.               WHEREAS, it is expedient to amend the Sardar Bahadur Khan Women’s
University Quetta Act, 2004 (Act No. IX of 2004) into the manner hereinafter to amend the Sardar Bahadur Khan Women’s University Quetta Act, 2004 (Act No.
IX of 2004) appearing;
       It is hereby amended as follows;

Short title and        1.         (1) This Act may be called the Sardar Bahadur Khan Women’s University Commencement.

Section 2, Act IX of 2004.
 













Amendment of
Section 7, Act IX of 2004. 

Quetta (Amendment) Act, 2014.

            (2)  It shall come into force at once.

2.         In the Sardar Bahadur Khan Women’s University Quetta Act, 2004 (Act IX of 2004), hereafter referred to as the said Act, in Section 2,
(a)          after clause (v), the following new clauses (v-a) and (v-b) shall be inserted:-
“(v-a) “Selection Board”  means the Selection Board constituted by the Chancellor for appointment of staff in BPS-18 and above; 
(v-b) “Selection Committee” means the Selection Committee constituted by the Chancellor for appointment of Faculty and non Faculty staff in BPS- 17 and be low;”
(b)          after clause (q), the following new clause shall be inserted:-
“(q-a) “Pro-Vice  Chancellor” means the Pro-vice Chancellor of the University appointed under Section 13A of this Act;”;

3.               In the said Act, in Section 7, after clause (b), the following new clause shall be inserted, namely:-
             
“(b-a) the Pro-Vice Chancellor”



Amendment of
Section 11,
Act IX of 2004.
4.               In the said Act, in Section 11, after sub-section (1), the following new subsection shall be inserted, namely:-



 “(1-A) At any time when the office of the Vice Chancellor is  vacant  or the Vice Chancellor proceeds on official tour or on leave or is unable to perform the functions of her office due to illness or some other reason, the Pro-Vice Chancellor will perform the duties of the Vice Chancellor.” 

Amendment of Section 12, Act IX of 2004.

5.     In the said Act, in Section 12, in sub section (4):-
(a)   in clause (d) for the word “fifty” the word “five hundred” shall be substituted; and 
(b)   for clause (i), the following shall be substituted:-
                              “i” to appoint a faculty employee in basic pay scale 18 and Non Faculty employees (B-17 and blow) on temporary basis for a period not exceeding six months, exclusively against the sanctioned posts:

               Provided that the same post/s shall be filled on regular basis by adopting the regular recruitment procedures and final recommendations of Selection Board and Selection Committee. 
Insertion of
New Sections
13-A and 13-B,
Act IX of 2004.







 







 
6.   In the said Act, after Section 13, the following new Sections shall be inserted, namely:-
 “13-A. Pro-Vice Chancellor. — (1) There shall be a Pro-Vice  Chancellor of the University, who shall be appointed by the Chancellor  for a term of three years initially, extendable to another term, and on  such terms and conditions as the Chancellor may determine.
                        (2)       The Chancellor, either on the recommendation of the
 Senate in pursuant to a resolution passed by a majority of three fourth            of its members or himself on his discretion, may by an executive order  remove the Pro-Vice Chancellor on the ground of inefficiency, moral  turpitude, physical or mental incapacity or gross misconduct including  misuse of position for personal advantage of any kind.

 13-B. Powers and duties of the Pro-Vice Chancellor. (1) The ProVice Chancellor shall assist the Vice Chancellor in all the matters  and affairs of the University.
  (2) All matters requiring orders, approval and sanctions of  the Vice Chancellor, shall be routed through the Pro-Vice Chancellor.   (3) The Pro-Vice Chancellor shall be an Ex-officio member  of all the Statutory Bodies of the University, such as, the Senate, the  Syndicate, the  Academic Council, the Finance and Planning  Committee, the Advanced Studies and Research Board, the Selection
            Board/Committee etc.”
Amendment of Section 18, Act IX of 2004.

7.   In Section 18, in sub-section (1) in clause (b),-
(a)    in subclause (v), at the end the word “and” shall be omitted;
(b)   in sub-clause (vi), at the end, for the full stop(.) a semi-colon(;) shall 
       be substituted; and

(c) after sub-clause (vi) as so amended, the following two new sub-    clauses shall be added;
“(vii) Selection Board; and 
 (viii) Selection Committee.”
Amendment of Section 19, Act IX of 2004.

8.       In the said Act, in Section 19, in sub-section for clause (d), the following shall be substituted.

“(d)    “two members of the Government i.e. the Principal Secretary  to Governor Balochistan and the Secretary Government of Balochistan,
Colleges, Higher and Technical Education Department;”
Amendment of Section 22, Act IX of 2004.


9.    In the said Act, in Section 22, in sub-section (1).-
(a)        in clause (f), the word “and” shall be omitted;
(b)       in clause (g), after the semi-colon (;), the word “and” shall be added;
(c)        after clause (g), as so amended, the following new clause shall be added:- “(h) three members of the Government i.e. Principal Secretary  to Governor, Secretary, Colleges, Higher and Technical Education Department and Secretary Finance Department as Ex-officio members;”.
