AN
ACT
to amend the Khyber
Pakhtunkhwa River Protection Ordinance, 2002
WHEREAS it is expedient to amend the
Khyber Pakhtunkhwa River Protection Ordinance, 2002 (Khyber Pakhtunkhwa
Ordinance NO. III of 2002) for the purposes hereinafter appearing;
It
is hereby enacted as follows:
1.
Short title
and commencement.---(1) This Act may be called the Khyber Pakhtunkhwa River
Protection (Amendment) Act, 2014.
(2)
It shall come into force at once.
2.
Amendment of
section 2 of the Khyber Pakhtunkhwa Ordinance No. III of 2002.---In the
Khyber Pakhtunkhwa River Protection Ordinance, 2002 (Khyber Pakhtunkhwa
Ordinance No. III of 2002) hereinafter referred to the said Ordinance, in
section 2,--
(i)
in clause (a), for the words “Tehsil Municipal Officer
or any other”, the article “an” shall be
substituted; and
(ii)
after clause (j), the following new clause (jj) shall
be inserted, namely:
“(jj)
“NOC” means no objection certificate from Irrigation Department.”.
3.
Amendment of
section 5 of the Khyber Pakhtunkhwa Ordinance NO. III of 2002.---(1) In the
said Ordinance, the existing section 5, shall be renumbered as subsection (1)
of section 5 and after sub-section (1) as so renumbered, the following new
sub-section (2) shall be added, namely:
“(2) Any
organization or individual, who intends to construct bridge, culverts, crossing
structure and flood protection works on rivers, streams, nullahs, drains and
water channels shall obtain an NOC, before the commencement of works.”.
