Khyber Pakhtunkhwa Salaries, Allowances and Privileges Laws (Amendment) Act, 2014

ACT

further to amend the laws relating to the

Salaries and Allowances of the Members of the

Provincial Assembly of the Province of the Khyber Pakhtunkhwa  and Salaries, Allowances and Privileges of the Speaker and Deputy Speaker of the Province of the Khyber Pakhtunkhwa.

WHEREAS it is expedient further to amend the Provincial Assembly of the Khyber Pakhtunkhwa Province (Salaries and Allowances of Members) Act, 1974 (Khyber Pakhtunkhwa Act No. XI of 1974) and the Khyber Pakhtunkhwa Province Speaker and Deputy Speaker’s (Salaries, Allowances and Privileges) Act, 1975 (Khyber Pakhtunkhwa Act No. III of 1975), for the purposes hereinafter appearing;

It is hereby enacted as follows:

1.               Short title and commencement.---(1) This Act may be called the

Khyber Pakhtunkhwa Salaries, Allowances and Privileges Laws (Amendment) Act, 2014.  

(2)      It shall come into force at once. 

2.               Amendment of certain laws.---The laws specified in column 3 of the Schedule appended to this Act shall be amended to the extent and in the manner specified against each in column 4 of the said Schedule.

				Act, 1974.		clause  (c),  for  the  word             “three”, the word “fifteen”              shall be substituted; and (ii) in sub-section (3), for the  words  “forty  thousand”,  the  words  “one  lac  and  twenty thousand” shall be  substituted. 3.    In section 7, in the first proviso, for  the  word  “five”,  the  word “ten” shall be substituted.
					4 .			In  section  7C,  for  the  words  “three thousand”, the words “four thousand and eight hundreds” shall be substituted.
					5.			After section 7C, as so amended, the following new sections shall be inserted, namely:  “7D. House rent.---A member shall be entitled to receive house rent allowance at the rate of thirty thousand per month.  7E.   Conveyance Allowance.---   A member shall be entitled to receive conveyance allowance at the rate of six hundred and forty rupees per diem for the period of residence on duty and for the day of arrival and the day of departure from the place where a Session of the Assembly or a meeting of Committee is held or where any other business connected with his duties as such member is transacted only during Assembly Session.  7F. Increase in salary and other emoluments.---The salary and other emoluments of the members shall automatically be increased by Government in proportion increase to be made in the salary of the civil servants in BPS-20 from time to time.”.
					6.			In section 8,-  (i)              the existing section shall be re-numbered as subsection (1) of section 8 and in sub-section (1) as so re-numbered, the words  “as well as outdoor”, shall be deleted; and  (ii)            after sub-section (1), the following new sub-section shall be added, namely:  “(2) A member shall be entitled to receive medical allowance at the rate of nine thousand rupees per month.”.
2.		Khyber		The  Khyber		1.	In section 3, for the words “thirty

				Act, 1975.			“five”,  the  word  “ten”  shall  be substituted.
						4.	In  section  7,  in  sub-section  (3) and (4), for the word “sixteen”, the word “seventy” shall respectively be substituted.
						5.	In section 11, in clause (a), for the   word   “three”,   the   word “fifteen” shall be substituted.
						6.	In section 13, for the word “one”, the     word   “two” shall    be substituted.
						7.	After  section  14,  the  following new  sections  shall  be  inserted, namely:                                         “14A. Additional Travelling Allowance.---The  Speaker  shall be   entitled   to   receive   an Additional Travelling Allowance at the rate of two lac per annum. 14B. Medical Allowance.--- The Speaker shall be entitled to receive Medical Allowance at the rate of eighteen thousand rupees per month.”.
						8.	In  section  18,  for  the  words “twenty seven”, the words “fifty four” shall be substituted.
						9.	In  section 19A, for the word “six”,  the  word  “ten”  shall  be substituted.
						10.	In  section  19C,  for  the  word “three”, the word “five” shall be substituted.
					11.			In section 20,-  (i)         in sub-section (2), for the words “one hundred thousand”, the words “ten hundred thousand” shall be substituted; and  (ii)       in sub-section (3) and (4), for the words “thirty five”, the words “fifty five” shall be substituted.
					12.			In section 21, in sub-section (1), in clause (i), the words “first or” shall be deleted.
					13 .			In  section  24,  for  the  word  “three”, the word “fifteen” shall be substituted.
					14.			After section 25, the following new sections shall be inserted, namely:  “25A. Additional Travelling Allowance.---The Deputy Speaker shall be entitled to receive an Additional Travelling Allowance at the rate of one lac fifty thousand rupees per annum.  “25B.   Medical   Allowance.---  The Deputy Speaker shall be entitled to receive Medical Allowance at the rate of fifteen thousand rupees per month.”.
					15.			After section 31, the following new section shall be inserted, namely:  “31A. Increase in salary and other emoluments.---The salary and other emoluments of Speaker and Deputy Speaker shall automatically be increased by Government in proportion increase to be made in the salary of the civil servants in BPS-20 from time to time.”.
