No. PA/NWFP/Legis-I/2003/17328.—The Shari Nizam-e-Adl (Amendment) Bill, 2003, having been passed by the Provincial Assembly of North-West Frontier Province on the 30th May, 2003 and assented to by the Governor of the North-West Frontier Province on 12th June, 2003 is hereby published as an Act of the Provincial Legislature of North-West Frontier Province.

further to amend the Shari' Nizam-e-Adl Act, 1999.

Preamble.—WHEREAS it is expedient further to amend the Shari' Nizam-e-Adl Act, 1999 (N.­W.F.P. Act No. VII of 1999), in the manner hereinafter appearing;
It is hereby enacted as follows:—
1.             Short title and commencement.—(1) This Act may be called the Shari' Nizam-e-Adl
(Amendment) Act, 2003.
(2)        It shall come into force at once.
2.             Amendment of section 5 of N.-W.F.P. Act No. VII of 1999.—In the Shari' Nizam-e-Adl Act, 1999 (N.-W.F.P. Act No. VII of 1999), hereinafter referred to as the said Act, in section 5, for the words "Executive Magistrate", wherever occurring, the words "Magistrate-cum-Illaqa Qazi" shall be substituted; and
3.             Amendment of section 7 of N.-W.F.P. Act No. VII of 1999. --- In the said Act, in section 7,—

1. in sub-section (2) and (3), for the words "District Magistrate", wherever occurring,
   the words "District Police Officer" shall be substituted; and
2. in sub-section (5), for the words "Executive Magistrate" and the words "Sub-Divisional Magistrate", wherever occurring, the words "Magistrate/Aa'la A'alaqa Qazi" shall respectively be substituted.

4.             Amendment of section 8 of N.-W.F.P. Act No. VII of 1999.—In the said Act, in section 8, in sub-section (1), for clause (v), the following shall be substituted, namely:
"(v)        District Coordination Officer of the District concerned; and"

1. Amendment of section 9 of N.-W.F.P. Act No. VII of 1999.— In the said Act, in section 9, for the words "District Magistrate", wherever occurring, the words "District Coordination Officer", shall be substituted.
2. Amendment of section 15 of N.-W.F.P. Act No. VII of 1999.—In the said Act, in section 15,-
3. for the words "District Magistrate", the words "District Coordination Officer" shall be substituted;
4. for the words "Executive Magistrate", wherever occurring, the words "Magistrate-cum-Illaqa Qazi" shall be substituted; and
5. for the words "Sub-Divisional Magistrate", the words "Magistrate/Aa'la Illaqa Qazi" shall be substituted.

7.             Amendment of section 16 of N.-W.F.P. Act No. VII of 1999.— In the said Act, in section 16-

1. in  the  marginal  heading,  for the  words  "Executive  Magistrate",  the  words "Magistrate" shall be substituted;
2. in sub-section (1), for the words and comma "a District Magistrate and as many Additional District Magistrates, Sub-Divisional Magistrates and other Executive Magistrates",  the words "as many Magistrates" shall be substituted; and
3. in sub-section (3) and (4), for the words "District Magistrate" the words "District Coordination Officer of the District concerned" shall  be substituted.

8.             Repeal.—The Shari Nizam-e-Adl (Amendment) Ordinance, 2003 (N.-W.F.P. Ordinance No. II of 2003) is hereby repealed.
