The Sindh Water Management  (Amendment)  Bill, 2005 have been passed by the  Provincial  Assembly  of  Sindh  on  Wednesday,  the  19th   October,  2005  and  assented  to  by  the Governor of Sindh on 22nd March, 2006 is hereby published as an Act of the Legislature of Sindh.

THE SINDH WATER MANAGEMENT (AMENDMENT) ACT, 2005

SINDH ACT NO.II OF 2006

(First  published  after having  received  the assent  of the Governor  of Sindh  in the Gazette  of

Sindh (extra‐Ordinary) dated 03rd April, 2006)

AN ACT

to amend the Sindh  Water Management Ordinance, 2002.

Preamble                                  WHEREAS  it is expedient  to amend the Sindh Water Management  Ordinance, 2002, in the manner hereinafter appearing;

It is hereby enacted as follows:‐

1.    Short title and commenceme

(1)           This Act may be called the Sindh Water Management (Amendment) Act, 2005

(2)           It shall come into force at once.

2.  Amendment of Section 5 of Sindh Ordinance XL of 2002.

(i)  in  sub‐section  (1),  in  clause  i,  for  sub‐clause     a,  the  following  shall  be substituted:

“a. Minister  Irrigation  and Power  or any person  appointed  by

Government ………………………..Chairman;”; and

(ii) for sub‐section (8), the following shall be substituted:‐

“(8)    The  Chairman  other  than  the  Ex‐officio  Chairman  or  a Member shall not hold any political office and where if the Chairman  other  than  the  Ex‐officio  Chairman  or a Member  is elected, nominated or appointed to any political office, he shall cease to be the Chairman or a Member with immediate effect.”.

3. Amendment of section 8 of Sindh Ordinance XL of 2002.          In the said Ordinance, for section 8, the following shall be substituted:‐

“8. (1) The Chairman and Members shall serve the SIDA on such terms and conditions as may be prescribed.

(2)  The  Chairman   other   than   the  Ex‐officio   Chairman   and  the

Members  other than the Ex‐officio  members  shall, unless resigned  or removed  earlier,  hold  office  for  a  period  of  four  years  and  shall  be eligible for re‐appointment for   the second term.”.

4.   Repeal        The  Sindh   Water   Management   (Amendment)   Ordinance,   2005,   is  hereby repealed.
