further to amend the West Pakistan (Board of Intermediate and Secondary Education, Peshawar, Ordinance, 1961.

Preamble

WHEREAS it is expedient further to amend the West Pakistan (Board of Intermediate and Secondary Education, Peshawar) Ordinance, 1961 (W. P.Ord: XIX of 1961) in the manner hereinafter appearing:

It is hereby enacted as follows:—

Short title, extent and commencement.

1.         (1) This Act may be called the West Pakistan (Board of Intermediate and Secondary Education, Peshawar) North-West Frontier Province Amendment) Act, 1976.

(2) It shall come into force at once.

Amendment of section I of W.P. Act XIX of 1961

2.         In the West Pakistan (Board of intermediate and Secondary Education Peshawar) Ordinance, 1961, hereinafter referred to as the said Ordinance, in section I, for sub-section (1), the following sub-section shall be substituted, namely:—

"(1) This Ordinance may be called the Board of Intermediate and Secondary Education (Peshawar) Ordinance, 1961."

Amendment of section 4 of W.P. Act XIX of 1961

3.         In the said Ordinance, in section 4. for sub-section (1), the following sub-section shall be substituted, namely:—

'"(1) The Board Shall consist of the following members, namely:—
(i)      The Chairman;
(ii)     the Vice-Chancellor of the University of Peshawar or a Professor of the said University nominated by him;
(iii)    the Vice-Chancellor of the Gomal University or a Professor of the said University nominated by him;
(iv)    the Director of Education, North-West Frontier Province;

            (v)    one expert on technical education to be nominated by the Controlling Authority;
            (vi)   one representative of the Syndicate of the University of Peshawar to be elected by the said Syndicate;
            (vii)  one representative of the Syndicate of the Gomal University to be elected by the siad Syndicate ;
            (viii) one Principal of a College for men to be elected by the Principals of such Colleges ;
            (ix)   one Principal of a college for women to the elected by the Principals of such Colleges;
            (x)    one Headmaster or Headmistress of a School elected by and from among the Headmasters and Headmistresses of Schools;
            (xi)   two persons eminent in the Sciences, Arts, or other Professions to be nominated by the Controlling Authority".

4.         In the said Ordinance , for section 5, the following section shall be substituted, namely: —

"5. Resignation of members— A member of the Board, including the Chairman, may resign his membership by letter addressed to the Controlling authority."

5.         In the said Ordinance, for section 6, the following section shall be substituted. namely: —

"6. Removal of members — A member shall be liable to be removed by the Controlling Authority if—
            (i)     he has become of unsound mind;
            (ii)    he has, in the opinion of the Controlling Authority, become incapable of performing his functions as such member.
            (iii)   he has been declared insolvent by a competent court ;
            (iv)   he has at any time been convicted for any offence which, in the opinion of the Controlling Authority, is an offence involving moral turpitude." —

6.         In the said Ordinance, in section 13, after sub-section (5). the following new sub-section shall be added, namely: —

(6), Notwithstanding anything to the contrary contained in this Ordinance Regulations or Rules, the Controlling Authority may—
(a)     place the services of any of the officers or other employees of the Board at the disposal of Government or any University or Institution for such period and on such terms and conditions as may be determined by him; provided that such terms and conditions shall not be less favourable than those admissible to him immediately before his transfer; or
(b)     make appointments to any post in the Board from persons in the service of Pakistan or from officers or other, employees of any University or other Institution".

Amendment of section 15 of W.P. Act XIX of 1961

7.         In the said Ordinance, in section 15, for sub-section (2), the following sub-section shall be substituted, namely:—

"(2) The Chairman shall hold office during the pleasure of the Controlling Authority for a term not exceeding four years.".

Repeal

8.         The West Pakistan (Board of Intermediate and Secondary Education Peshawar) (North-West Frontier Province Amendment) Ordinance. 1976 (N.-W.F.P. Ordinance No.XI of 1976), is hereby repaled.
