NOTIFICATION
Dated Lahore the: ____________2012.
No. SO(PI)6-67/83 in exercise of the powers conferred on him by Section-17 of the Punjab Government, Educational and Training Institutions Ordinance, 1960 (XI of 1960). The Governor of the Punjab is pleased to make the following Rules namely:-

The Punjab Library Foundation, Lahore.
(Appointment and Conditions of Service Regulations, 2012)
In exercise of the powers conferred on him by Section 18, (1) and (2), (e),(f) of the Punjab Government, Educational and Training Institutions Ordinance, 1960 (XI of 1960), and with the prior approval of Govt. of the Punjab, the Board of Governors of the Punjab Library Foundation is pleased to make the following Regulations namely The Punjab Library Foundation (Appointment and Conditions of Service Regulations,),
2012”:-
1.SHORT TITLE AND COMMEENCEMENT.
i)These Regulations may be called the Punjab Library Foundation, Appointment and Conditions of Service Regulations, 2012
ii)They shall come into force at once.
2.DEFINITIONS
These Regulations, unless there is anything repugnant in the subject or context, the following expressions shall have the meaning hereby respectively assigned to them, that is to say:-
i)“Board” means the Board of Governors of the Punjab Library Foundation.
ii)“Government” means Government of the Punjab;
iii)“Foundation” means the Punjab Library Foundation;
iv)“Chairman” means the Chairman of the Board appointed under Section 4
(2) of the Ordinance;
v)“Secretary” means the Secretary of the Board
vi)“Employee” means the employees of the Punjab Library Foundation;
vii)“Selection Committee” means the Selection Committee constituted by the Board of Governors as mentioned in these regulations;
viii)“Executive Committee” means the Executive Committee appointed by the Board as mentioned in the Punjab Library Foundation, Lahore, Financial Regulations, 2012.
ix)“Deputy Director” means the officer appointed by the Board to be the Deputy Director, of the Punjab Library Foundation.
3.RECRUITMENT TENURE OF OFFICE, TERMS AND CONDITIONS OF SERVICE.
i.The Board may employ necessary staff on the basis of permanent, deputation, daily wages, project employee and temporary (on contract basis) for the smooth functioning of the office of the Foundation. The terms and conditions of the employees will be the same as prescribed under these regulations.
a)the employees to be appointed by the Board, other than permanent staff, on the basis of deputation, daily wages, project employee and temporary (on contract basis) shall be recruited /appointed by the competent authority as prescribed in Schedule-A with the approval of the Board.
ii.Subject to the provision of these Rules and Regulations the terms and condition of the officers and officials appointed by the Board, other than Government servants
transferred to the Foundation or whose services have been obtained on loan from a Government Department or Agency, shall be as provided in the Service Rules & Regulations applicable to the corresponding class or category of Govt. servants and such Rules & Regulations shall mutatis mutandis apply to them.
iii.An employee may resign or his services be terminated from service in accordance with the rules prescribed by Government of the Punjab from time to time.
iv.Where an employee of the Foundation is formally appointed to an additional post and discharges full duties of the post, he shall be entitled to additional pay as prescribed by Government of the Punjab from time to time.

METHOD OF RECRUITMENT
i.
Appointments to various posts in the Foundation shall be made in

such manner, by such authority and possessing such qualifications,

experience and age, as specified/prescribed in scheduled “A”, subject to

the procedure, directions/policies of Govt. of the Punjab issued form time

to time.
ii
Appointments whether by initial recruitment or transfer or

deputation or contract and project employee to various posts in BS-17 and

above in the Foundation may be made by the Board on the

recommendations of the Executive Committee which shall act as Selection

Committee in such appointments, subject to the provision of these Rules

and Regulations.
iii
The appointments whether by initial recruitment or transfer or

deputation or any other types to all posts from BS-12 to BS-16 or

equivalent may be made by the Secretary. The initial recruitment may be

made by the Secretary on the recommendations of Selection Committee,

subject to the provision of these Rules and Regulation.
iv
The appointments whether by initial recruitment or transfer or

deputation and any other types to all posts from BS-01 to BS-11 or

equivalent may be made by the Deputy Director. The initial recruitment

may be made by the Deputy Director on the recommendations of Selection

Committee, subject to the provision of these Rules and Regulation.
v
All appointments shall be made on merit and through

advertisement in accordance with the policy of Govt. of the Punjab

notified from time to time.
vi
Initial appointment and promotion to the post form BS-01 to BS-16
may be made by the Competent Authorities as mentioned in the schedule
“A”
on the recommendations of Departmental Selection,
Recruitment/Promotion Committee.

In the absence of the Deputy Director , PLF, the powers of the
Deputy Director , PLF shall be exercised by the Director, Public Libraries Punjab, Lahore.
5.PROBATION
i.A person appointed against a regular post by direct recruitment shall remain
on probation for a period of one year, provided that the appointing authority may extend the period of probation by a further period not exceeding one year.
ii.On completion of period of probation, the appointing authority may confirm the probationer in his appointment if his work and conduct have, in the opinion of such authority, been satisfactory.
iii.If the work and conduct of the probationer in the opinion of appointing authority has not been found to be satisfactory during the period of probation:
a)in case he has been appointed by direct recruitment, his services may be dispensed with one month’s prior notice or payment of one month’s salary in lieu thereof, at any time.
b)In case he has been appointed by promotion or transfer
from
other department, he may be reverted to his former
post or
department as the case may be.
iv.If no orders have been made by the day following the completion of initial probationary period, the period of probation shall be deemed to have been extended by one year. If no orders have been made by the day on which the period of probation so extended expires, the probationer shall be deemed to have been confirmed in his appointment.
6SENIORITY
The seniority of employees shall be determined as per rule applicable to the employees of Govt. of the Punjab.
7.ADMINISTRATIVE POWERS OF THE BOARD, CHAIRMAN, SECRETARY AND DEPUTY DIRECTOR
a)BOARD:
i)The Board shall be the final administrative authority of the Foundation. It shall lay down the general policy and may issue directions to its Secretary and other functionaries to achieve the objectives of the Foundation.
ii)The appointments from BS-17 and above may be made by the Board on the recommendations of the Executive Committee which shall act as Selection Committee for the posts of PLF from BS-17 and above.
iii)The Board shall be the Competent Authority in disciplinary matters against the employees for which it is Appointing Authority.
b)THE CHAIRMAN:
i)Subject to the general policy and decisions of the Board, shall exercise general supervision and provide guidance to the Foundation;
ii)To relax the upper age limit up to 5 years for Foundation posts from BS 17 and above if he is satisfied that strict application of the provision regarding age limit would not be in the interest of the Foundation or would cause undue hardship to the individual.
c)THE SECRETARY:
i.May appoint all employee BS-1 to BS-16 of the Foundation to hold charge of more than one post at one time up to a maximum limit of 4-months, extension may be made according to Government policy/directions issued from time to time provided that such an arrangement shall not involve any promotions;
ii.May distribute the business amongst the employees and assign the duties to be performed by them in connection with the affairs of the Foundation in the manner and the extent as he may deem fit.
Provided that in case of employees in BS-17 and above the Secretary shall exercise the power subject to prior approval of the Board
iii.To attend or nominate an officer/officers to attend conferences, seminars, or workshops both inside and outside the country;
iv.To allow the period spent on extraordinary leave to be counted for increments in respect of posts for all employees up to BS-16 provided that the leave was taken on medical grounds or any other cause beyond the employee’s control. In case of the employees in respect of whom the Executive Committee is the appointing authority, such cases shall be referred to the Executive Committee;
v.To declare the grade for the purpose of T.A and D.A. in which part time employee of the Foundation shall rank;
vi.To allow mileage allowance by a route other than the shortest or cheapest route provided that selection of the route is in public interest;
vii.To sanction travel by air in the case of an employee of the Foundation who is not so entitled in case of absolute urgency and necessity provided that a return in respect of all such cases are furnished to the Board;
viii.To alter, in the case of clerical errors, the date of birth recorded in the Service Books or Service Roles of an employee of the
Foundation within two years of joining service and subject to the same restrictions as are applicable to Government servants;
ix.To relax the upper age limit up to five years for Foundation posts up to grade 16 if he is satisfied that strict application of the provision regarding age limit would not be in the interest of the Foundation or would cause undue hardship to the individual.
x.To grant all kinds of leave in accordance with the Leave Rules applicable to the servants of Govt. of the Punjab subject to the variations made by the Board in schedule “B”;
xi.Shall be the Chief Executive/Principal Officer of the Foundation and exercise full power of a controlling officer in respect of traveling allowance and the employees of the Foundation.
xiiTo create temporary posts up to BS-16 for a period not exceeding six months provided that such expenditure is met within the sanctioned budget and the matter shall be place before the Board in its next meeting;
xiiiTo grant exemption from the regulations limiting a halt on tour;
xivTo grant daily allowance at the rates as admissible under Government Rules for compulsory halt due to dislocation of communications;
xvTo sanction travel by air in the case of an employee of the Foundation who is not so entitled in case of absolute urgency and necessity provided that a return in respect of all such cases are furnished to the Board;
xviTo sanction leave encashment of employees of PLF and the employee appointed in the PLF on deputation.
8.RELAXATION.
Any of these Regulations may, for reasons to be recorded in writing, be relaxed by the Board in individual cases if the Board is satisfied that strict application of the Regulations would not be in the interest of the Foundation or would cause undue hardship to the individual, but without affecting the right of any other employee.
9.EFFICIENCY AND DISCIPLINE RULES
In disciplinary matters including representations of substantial nature, in cases of employees of the Foundation all matters shall be dealt in accordance with Govt. of the Punjab rules issued from time to time for such actions
Subject to such variations as may be made by the Board. The authorities shall act in respect of the Foundation employees as specified in schedule “D”.
10.LEAVE RULES
i)All types of leave cannot be claimed as a matter of right, but can be granted at the discretion of the concerned Authority as mentioned in schedule “B”.
ii)The Leave (other than Casual leave) to employees of the Punjab Library Foundation shall be allowed and regulated as per Rules applicable to servants of Government of the Punjab
Subject to such variations as may be made by the Board as specified in schedule “B”.
iii) The Casual Leave may be granted subject to the following conditions-:
a)Twenty Five days Casual Leaves will be allowed during the year (January to December), but not more than 10-days casual leaves including gazetted holidays shall be granted at a time.
b)Not more than 15-days leave shall be granted in the first half of the year.
11.PERFORMANCE EVALUATION REPORTS.
The Instructions about Performance Evaluation Reports issued by the Government of the Punjab shall also be applied mutatis mutandis to the employees of the Foundation.
Subject to such variations as may be made by the Board. The authorities shall act in respect of the Foundation employees as specified in schedule “C”
12MEDICAL FACILITIES
i.In door treatment of the employees of PLF may be allowed by the Secretary BOG. A list of hospitals may be notified by the Secretary with approval of the Chairman. Out door medical facilities may be provided may be provided as per policy applicable to the employs Govt. of the Punjab.
