is hereby published as an Act of the Balochistan Provincial Assembly.
BALOCHISTAN MINES
(AMENDMENT) ACT, 2011 ACT No. IV OF 2011
(First published after having received the
assent of the Governor Balochistan in the Balochistan Gazette (Extra-ordinary)
dated 21st May, 2011.

ACT
further
to amend the Mines Act 1923 (Act No.IV of 1923)

Preamble.
|
Whereas, it is expedient further to amend
the Mines Act, 1923 (Act No. IV of 1923) in the manner hereinafter appearing;
It is hereby enacted as follow:-

Short title, extent
and
Commencement.
|
1. (1)
This Act may be called the Balochistan Mines (Amendment) Act, 2011.
(2) It shall extend to the
whole of Balochistan except the Tribal Areas.
(3)
It shall come into force at once.

Amendment
of
Section
30-A, Act
No.
IV of 1923.
|
2.
In the Mines Act 1923 (Act No. IV of 1923), hereinafter referred as
the said Act, in section 30-A, in clause (d), for the words “duty of
excise” the words “ duty of Safety / Rescue / Training” and for
the words “ three paisa” the words “ five rupees” shall be
substituted.

Amendment
of Section 36,
Act No. IV of 1923.
|
3.
In the said Act, in section 36, after the word “fine” the words
“not less than four thousand rupees” shall be inserted and for the
words “four hundred” the words “six thousand” shall be
substituted.
|
|
Amendment
of section 39, Act No. IV of 1923.
|
4.
In the said Act, in section 39, after the word “fine” the words
“not less than five thousand rupees” shall be inserted and for the
words. “two thousand” and “two hundred” the words “twenty
thousand” and “five hundred” shall be substituted, respectively.

Amendment
of section 40, Act No. IV of 1923.
|
5. In the said Act, in section 40, in
sub section (1),
(a) for the words “which
may extend to four thousand rupees” the words: “not less than forty
thousand rupees”,
(b) for the words “which
may extend to two thousand rupees” the words “ not less than twenty
thousand rupees”, and
(c) for the words “which
may extend to one thousand rupees” the words “not less than ten
thousand rupees” shall be substituted.
