NO.PAS/LEGIS-B-8/2003-.  The Sindh Regularization of Doctors appointed on contract basis Bill, 2003 have been passed by the Provincial Assembly of Sindh on 13th November,
2003 and assented to by the Governor of Sindh on 5t December, 2003, is hereby published as an Act of Legislature of Sindh.

THE SINDH REGULARIZATION OF DOCTORS APPOINTED ON CONTRACT BASIS ACT 2003

SINDH ACT NO.V OF 2003

Gazette of Sindh (Extra-Ordinary) dated 20th December, 2003).

AN ACT

to  provide  for  regularization  of  the  services  of  certain  doctors  appointed  on contract.


WHEREAS it is expedient in the public interest to provide for regularization of services of certain doctors appointed on contract basis, in the manner hereinafter appearing;

It is hereby enacted as follows:-
1.         (1)       This Act may be called the Sindh Regularization of Doctors appointed on contract basis Act, 2003.

(2)       It shall come into force at once.

2.        In this Act, unless the context otherwise requires.
(a)       “Act” means the Sindh Civil Servants Act, 1973;
(b)       “civil servant” has the same meaning as assigned to it in the Act;
(c)        “appointment  of  a  Doctor  on  contract”  means  appointment  of  a  duly qualified Doctor made on contract basis;
(d)       “Government” means the Government of Sindh; and
(e)       “post” means a post sanctioned by Government connected with the affairs of the Province but does not include the post earmarked for a project and co-exist with such project.

Notwithstanding any thing contained in the Act or rules thereunder, or in any decree, order or judgment of a court, but subject to other provisions of this Act, a doctor appointed on contract basis and holding such appointment for more than a year and is in employment on the commencement of this Act, shall be deemed to have been validly appointed to that post as a civil servant on regular basis with effect from the date of commencement of this Act.

Provided that the services of a doctor, who does not possess the qualifications prescribed for the post, shall not be regularized.
