THE SINDH WILDLIFE PROTECTION (AMENDMENT) ACT, 2008


SINDH ACT NO: II OF 2009


(First published after having received the assent of the Governor of Sindh in the Gazette of Sindh (Extra-Ordinary) dated 29th January, 2009.)

AN 

ACT




                      to amend the Sind Wildlife Protection  Ordinance, 1972.


                     WHEREAS it is expedient to amend the Sind Wildlife
Protection Ordinance, 1972, in the manner hereinafter appearing; 
                      
                       It is hereby enacted as follows :-

1.   (1)      This Act may be called Sindh Wildlife Protection (Amendment) Act, 2008.

      (2)       It shall come into force at once.

Short title and commencement.
2.     In the Sind Wildlife Protection Ordinance, 1972, hereinafter called the said Ordinance,  in section 17, for sub-section (1-A), the following shall be substituted :-
Amendment of section 17 of Sind Ordinance V of 1972.


               "(1-A) Notwithstanding the provisions of sub-section(1), whoever illegally hunts – 

(i) rabbit (hare) shall be punished with imprisonment of either description for a term which shall not be less than one month or more than six months and with a fine upto one hundred fifty thousand rupees, but not less than one hundred  thousand rupees;
 



(ii)

deer and hog deer or phara shall be punished with imprisonment of either description for a term which shall not be less than two months or more than twelve months and with a fine upto two hundred thousand rupees, but not less than one hundred fifty thousand rupees;
(iii)

Sindh Ibex or wildgoat and urial or wildsheep shall be punished with imprisonment of either description for a term which shall not be less than two months or more than twelve months and with a fine upto four hundred thousand rupees, but not less than three hundred thousand rupees; and
(iv)
of any game animals i.e. patridge,
sandgrouse and waterfowl  shall be punished with imprisonment of either description for a term which shall not be less than fifteen days or more than three months and with a fine upto one thousand rupees, but not less than two hundred fifty rupees for each game animal.".

3.   In the said Ordinance, in section 33, in  sub-section (3), for the words "fifteen thousand", the words "fifty thousand" shall be substituted.
