NO.PAS/LEGIS-B-3/2003-  The Sindh Advisors (Appointments, Powers, Functions, Salaries, Allowances and  Privileges) Bill,  2003  have  been  passed by  the  Provincial Assembly of Sindh on 26th February, 2003 and assented to by the Governor of Sindh on 10th March, 2003, is hereby published as an Act of the Legislature of Sindh.

to provide for appointments, powers, functions, salaries, allowances and privileges of Advisors to the Chief Minister of Sindh

 AN ACT



Preamble  WHEREAS it is expedient to provide for appointments, powers, functions, salaries, allowances and privileges of Advisors to the Chief Minister of Sindh;


It is hereby enacted as follows:-

1.Short title and commencement         (1)       This Act may be called the Sindh Advisors (Appointments, Powers, Functions, Salaries, Allowances and Privileges) Act, 2003.

(2)       It shall come into force at once and be deemed to have taken effect on and from 1st January, 2003.

2.Definitions         In  this  Act,  unless  the  subject  or  context  otherwise  requires,  the  following expressions shall have the meanings hereby assigned to them respectively:

(a)       "Advisor" means a person appointed as an advisor to the Chief Minister under this Act;
(b)       "Chief Minister” means the Chief Minister of Sindh;
(c)       "Family” means the wife, children and parents residing with and wholly dependent upon the advisor;
(d)       “Governor” means the Governor of Sindh;
(e)       “Government” means the Government of Sindh;
(f)        “Prescribed” means as prescribed by rules framed under this Act.

3. Overriding effect        The provisions of this Act shall have effect notwithstanding anything to contrary contained in any other law or any judgment, order or decree of any Court.



4. Appointment and term of office        (1)       The Chief Minister may, in his discretion from time to time advise the Governor to appoint such number of persons as he considers necessary, to be advisors who shall hold office during the pleasure of the Chief Minister.


Provided that any Advisor appointed on or after 1st January, 2003 shall be deemed to have been appointed under this Act.

(2) An Advisor shall exercise such powers as may be delegated and perform such functions as may be assigned to him by the Chief Minister.


5. Salaries, Allowances and Privileges        An Advisor shall be entitled to such salary, allowances and other privileges as may be determined by Government from time to time.



6. Jurisdiction barred        Save as provided under this Act, no order made or proceedings taken under this Act, or the rules made thereunder by Government or an Advisor shall be called in question in any court and no injunction shall be granted by any court in respect of any decision made or proceedings taken in pursuance of any power conferred by, or under this Act or rules made thereunder.

7. Power to make rules        Government may, by notification in the official Gazette, make rules for carrying out the purposes of this Act.
